2026 Statutory Maternity, Vacation, Sick Leave and Public Holiday Pay Rules Across 12 Caribbean Jurisdictions

Caribbean leave rules split the cost between employer and social security in different ways: Barbados and Guyana pay maternity largely through NIS, Jamaica and Cayman put more of it on the employer, and the Dominican Republic adds a mandatory 13th month salary of 8.33% of annual wages. Budget leave as an accrual from the first payroll, and confirm each entitlement with the Ministry of Labour before writing it into contracts.

Who pays: employer or social security

Leave is where a payroll that looks cheap on contribution rates can turn expensive. The question to answer for each country is not only how many days, but who funds the pay:

  • Employer-paid. Vacation and public holidays are employer-paid everywhere. In several jurisdictions the employer also pays part of maternity leave and the first days of sick leave.
  • Social security-paid. NIS or its equivalent pays maternity and sickness benefits in many islands, funded by the contributions you already remit. The employer may be required to top up to full pay, or may choose to.
  • Statutory bonuses. The Dominican Republic's Salario de Navidad (1/12 of annual ordinary wages, payable by December 20) and Puerto Rico's Bono de Navidad (up to USD 600 depending on hire date and employer size) are cash obligations on top of leave.

Eligibility usually depends on service. Jamaica, for example, links paid maternity leave to continuous service, and vacation entitlements in most islands start after a qualifying period of work. Contracts can, and in competitive nearshore markets usually do, give more than the statutory minimum; the statute sets the floor and the more generous term applies.

The entitlements in this playbook are widely published baselines. Several were amended in recent years and categories of worker differ, so each line is marked to be confirmed with the Ministry of Labour or the social security authority before you rely on it.

Maternity leave baselines

The table summarises the commonly published maternity framework. Where we are not certain of the current pay split, it says so.

Most jurisdictions also protect the employee from dismissal because of pregnancy and guarantee return to the same or an equivalent role. Paternity leave is statutory in a minority of these jurisdictions and is often a contractual benefit instead; confirm locally.

Vacation, sick leave and public holidays

Vacation and sick leave minimums are set by holidays-with-pay legislation, labour codes or minimum wage orders, and are more uneven than maternity rules.

  • Jamaica. Two weeks of paid vacation after a qualifying year of work under the Holidays with Pay Order, rising to three weeks after long service; ten days of sick leave a year after a qualifying period. About ten public holidays.
  • Trinidad and Tobago. Vacation and sick leave minimums come mainly from the Minimum Wages Order and collective agreements; professional contracts usually give more. About 14 to 15 public holidays, among the highest in the region.
  • Barbados. Three weeks of vacation under the Holidays with Pay Act, four weeks after five years; sickness benefit is paid by NIS after waiting days.
  • Guyana. Holidays with pay accrue per month worked; NIS sickness benefit after waiting days.
  • Dominican Republic. 14 working days of vacation after one year, 18 after five years, plus the 13th month salary.
  • Bahamas, Cayman, Bermuda. Two weeks of vacation after one year is the common baseline, increasing with service.

Public holiday pay rules differ too: work on a public holiday commonly attracts a premium such as double time, and Jamaica, Trinidad and Barbados have statutory rules on when a holiday falling on a weekend moves to a weekday. Confirm each country's premium rate and calendar with the Ministry of Labour each January, and load the year's holidays into payroll before the first pay run.

Worked example: Dominican Republic leave and 13th month accrual

A Santo Domingo customer support team of 20 agents, each paid DOP 60,000 a month, all with between one and five years of service. Finance wants a monthly accrual for vacation and the Salario de Navidad. Daily salary in the DR is derived by dividing monthly salary by 23.83, the Labour Code factor for average working days per month.

13th month (Salario de Navidad) Annual ordinary wages = 60,000 x 12 DOP 720,000.00 Annual 13th month = 720,000 / 12 DOP 60,000.00 Monthly accrual = 60,000 / 12 DOP 5,000.00 (8.33%) Vacation (14 working days, years 1-5) Daily salary = 60,000 / 23.83 DOP 2,517.83 Annual vacation pay = 2,517.83 x 14 DOP 35,249.62 Monthly accrual = 35,249.62 / 12 DOP 2,937.47 Per employee per month = 5,000.00 + 2,937.47 DOP 7,937.47 Team of 20 = 7,937.47 x 20 DOP 158,749.40 At benchmark DOP 63.5 per USD USD 2,499.99 per month Annual team accrual = 158,749.40 x 12 DOP 1,904,992.80

These accruals sit on top of TSS contributions and INFOTEP. Vacation pay is a cost of cover only if you backfill absent agents, but on termination unused vacation and the proportional 13th month become cash. Setting up leave correctly: phases and owners

  1. Policy baseline (week 1, owner: People Ops). For each country, record the statutory minimum for vacation, sick leave, maternity and public holidays, and decide where your policy exceeds it.
  2. Contract wording (week 2, owner: Legal or EOR). State entitlements in days, the accrual basis and carry-over rules. EOR templates often default to the statutory minimum; check them against your global policy.
  3. Payroll configuration (week 2-3, owner: Payroll). Load public holiday calendars, holiday premium rates, the DR 13th month accrual and any employer top-up for maternity.
  4. Benefit claims (ongoing, owner: Payroll with employee). Where NIS, NIB, NIC or SVB pays a benefit, help the employee file promptly and decide whether you advance pay and reclaim.
  5. Accrual review (quarterly, owner: Finance). Reconcile leave balances to the general ledger, especially before year-end and before any restructuring.

Risks, controls and checklist

The common failures are using a single global leave policy that undercuts a local minimum, forgetting the DR 13th month in a mid-year budget, paying full salary during maternity without claiming the social security benefit, and terminating employees without paying out accrued leave.

  1. Statutory minimum for each leave type recorded per country and confirmed with the Ministry of Labour.
  2. Policy and contracts give at least the statutory minimum in every country.
  3. Public holiday calendar loaded for the year; premium rate configured.
  4. DR Salario de Navidad accrued monthly at 8.33% and paid by December 20.
  5. Puerto Rico Bono de Navidad eligibility checked for each employee.
  6. Maternity pay split between employer and social security documented, with the claim process assigned.
  7. Sick leave certificates and waiting days rules documented.
  8. Leave balances reconciled quarterly and paid out correctly on exit.

Straight answers

FAQs

How is the Dominican Republic 13th month salary calculated?

The Salario de Navidad equals 1/12 of the ordinary wages earned in the calendar year, payable by December 20. An employee on DOP 60,000 a month for the full year receives DOP 60,000. It is exempt from income tax up to five minimum wages.

Who pays maternity leave in Barbados?

Maternity pay in Barbados is paid mainly through the NIS maternity benefit, funded by the contributions employers and employees remit. Confirm the current benefit rate, the 12-week duration and eligibility conditions with NIS Barbados.

How many vacation days are statutory in the Dominican Republic?

Employees with one year of service are entitled to 14 working days of paid vacation, rising to 18 working days after five years. Unused vacation must be paid on termination, together with the proportional 13th month.

Does an EOR handle maternity benefit claims?

A good EOR or payroll bureau files or supports the social security claim and applies any employer top-up through payroll. Ask in writing whether the provider advances full pay and reclaims the benefit, and how the cost of any top-up is invoiced.

Are Caribbean leave entitlements the same for all employees?

No. Some minimums apply only to workers covered by minimum wage orders or holidays-with-pay legislation, and collective agreements often set higher terms. Confirm the category of worker with the Ministry of Labour before relying on a baseline.
